My Hold Harmless Agreement.

Below is a copy/paste of the hold harmless agreement I use when working with new clients for no fee.

I have my own liability insurance. If you don’t then you should remove #3 and any other said/implied verbiage of insurance coverage.

ON-SITE PHOTOGRAPHY / VIDEO VISIT

LIABILITY ACKNOWLEDGMENT & HOLD HARMLESS AGREEMENT

This acknowledgment confirms the understanding between the undersigned business (“Host”) and [Your Company Name], LLC (“Company”) regarding an unpaid, voluntary visit for photography and/or video coverage.

1. Independent Status

[Your Company Name], LLC is acting as an independent contractor and is not an employee, agent, partner, or representative of the Host.

1. Voluntary, Unpaid Visit

This visit is voluntary and unpaid unless otherwise agreed in writing. The Company is present solely for the purpose of capturing photography and/or video content.

1. Insurance

The Company maintains its own general liability insurance coverage. Proof of insurance can be provided upon request.

1. Assumption of Risk

The Company understands that being present at a place of business involves ordinary and inherent risks, including but not limited to slips, trips, falls, equipment damage, or other unforeseen incidents.

The Company voluntarily assumes responsibility for risks arising from its own actions, equipment, and operational activities while on the Host’s premises. Nothing in this agreement waives or limits the Host’s responsibility to maintain the premises in a reasonably safe condition or liability arising from the Host’s negligence or intentional misconduct.

1. Hold Harmless

The Company agrees to release and hold harmless the Host from claims or liabilities arising solely from the Company’s own actions, equipment, or operational conduct while on the premises.

This provision does not apply to claims resulting from the Host’s negligence, unsafe property conditions, or intentional misconduct.

1. Permission to Be Present

The Host grants permission for the Company to be present on the property for the stated purpose of photography and/or video capture during mutually agreed times.

1. Minors & Media Consent

If minors (individuals under 18) are present during the photography or video visit, the Host acknowledges that minors may appear in captured media both incidentally (as part of the event environment) and intentionally (such as participation in activities or demonstrations).

The Host confirms that any required parental or guardian permissions for photography or video capture have been obtained or communicated to attendees.

The Company is not responsible for collecting individual model releases unless specifically agreed to in writing prior to the event.

Acknowledgment

By replying in writing (including email or text message) confirming permission for [Your Company Name], LLC to be present on the premises, the Host acknowledges and agrees to the terms outlined in this document. The Company’s presence on the property following written confirmation constitutes mutual acceptance of these terms.
